1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your use of abelindia.com (the “Website”) and any purchase of products or services from ABEL Machines, a member of the R B Group, 1 km, Sahapur Khurd, Ballabgarh, Faridabad, Haryana 121004 (“ABEL”, “we”, “us” or “our”). By using the Website, sending an enquiry or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
Definitions
- “Products” means backhoe loaders, front end loaders, telescopic and grab loaders, Agri Max and GT loaders, buckets, attachments and spare parts sold by ABEL.
- “Services” means installation, fitment, maintenance, repair and after-sales support.
- “Customer” or “you” means any person, business, dealer or organisation that uses the Website or buys from us.
- “Dealer” means a party authorised by ABEL in writing to sell or service its Products.
2. Use of the Website
You may use the Website to learn about our Products, request quotes, apply for dealership and contact us. You agree not to:
- Submit false, misleading or someone else’s information in any form.
- Copy, scrape or republish Website content for commercial use without our written permission.
- Attempt to hack, overload, or introduce viruses or harmful code into the Website.
- Use the Website for any unlawful purpose.
Product images, specifications, capacities and features on the Website are for general information. They may change without notice as we improve our Products, and actual Products may differ slightly. Please confirm the final specifications in your quotation or order confirmation. We try to keep the Website accurate and available but do not guarantee that it will be error-free or uninterrupted.
3. Quotations, Orders and Pricing
- Enquiries are not orders. Submitting an enquiry or “Request a Quote” form does not create a contract.
- Quotations are valid for the period stated on them, or 30 days if no period is stated. They depend on the model, configuration, tractor compatibility, quantity and delivery location.
- Orders are binding only after we issue a written order confirmation or proforma invoice and receive the agreed advance payment.
- Prices are in Indian Rupees (INR) and, unless stated otherwise, exclude GST, freight, transit insurance, installation and other charges, which are added as applicable.
- Price changes. We may revise prices before order confirmation due to changes in raw material costs, taxes or government levies.
- Tractor compatibility. The Customer is responsible for confirming the tractor make, model and horsepower. ABEL is not liable for fitment issues caused by incorrect information.
- Cancellation. Confirmed orders may be cancelled only with our written consent. Advance payments may be forfeited to cover costs already incurred, especially for customised Products.
4. Payment, Delivery and Installation
Payment
- Payment terms are as stated in the quotation or proforma invoice. Typically an advance is due with the order and the balance before dispatch. [Confirm, e.g. 30% advance, 70% before dispatch.]
- Payments are accepted by bank transfer (NEFT/RTGS/IMPS), cheque, demand draft or approved finance partners. Cheques are subject to realisation.
- ABEL does not ask for payment to personal accounts. Always confirm bank details directly with us before paying.
- Overdue amounts may attract interest at [18%] per year, and we may hold dispatch until payment is received.
Delivery
- Delivery dates are estimates. Delays due to transport, raw material supply, strikes or other causes beyond our control do not entitle the Customer to cancel or claim compensation.
- Products are dispatched ex-works Faridabad unless agreed otherwise. Risk passes to the Customer when goods are handed to the carrier or collected.
- Inspect the Products on delivery and report any transit damage or shortage in writing within 48 hours, with photos.
Installation
- Fitment to the tractor is done by ABEL or an authorised Dealer, at the charges stated in the quotation.
- The Customer must provide a compatible tractor in good working condition at the agreed place and time.
5. Warranty, Returns and Service
Warranty. ABEL warrants that its Products are free from manufacturing defects in material and workmanship for [12 months from the date of invoice / installation], as stated on the warranty card. Under warranty, we will repair or replace defective parts at our option.
The warranty does not cover:
- Normal wear and tear of parts such as bucket teeth, cutting edges, pins, bushes, hoses, seals and filters.
- Damage from overloading, misuse, accidents, poor maintenance or use beyond rated capacity.
- Repairs or modifications by anyone other than ABEL or an authorised Dealer, or use of non-genuine spare parts.
- Defects in the tractor or other equipment not supplied by ABEL.
Returns. Products built or fitted to order are not returnable. Spare parts may be returned within 7 days only if unused, in original packing, and with prior written approval. Electrical parts and items sold as “special order” cannot be returned.
Service. Service requests and complaints can be raised with sales@abelindia.com, on +91 9810280709, or through any authorised service centre. Service outside warranty is chargeable.
6. Intellectual Property
All content on the Website, including the ABEL name and logo, product names (such as AB 01, AB 06, Agri Max and GT Loader), designs, drawings, photos, videos, text and software, belongs to ABEL Machines or its licensors and is protected by Indian intellectual property laws. You may not copy, reproduce, modify or use any of it without our prior written permission. Dealers may use ABEL branding only as allowed in their dealership agreement.
7. Limitation of Liability, Indemnity and Force Majeure
Safe use. Customers must operate Products as per the operator’s manual and safety instructions, by trained operators, and within rated capacity. ABEL is not liable for injury, death or damage caused by unsafe operation.
Limitation of liability. To the extent permitted by law, ABEL is not liable for any indirect, incidental or consequential loss, including loss of profit, business, contracts or machine downtime. Our total liability for any claim will not exceed the price paid for the Product or Service that gave rise to the claim.
Indemnity. You agree to indemnify ABEL against any claims, losses or costs arising from your breach of these Terms, misuse of the Products, or violation of any law.
Force majeure. We are not responsible for any delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, war, strikes, government action, power failures or supply disruptions.
8. Disclaimer
The information on this Website, including product specifications, capacities, dimensions, images, videos, brochures, certifications and performance figures, is provided for general information only. It is provided “as is” and “as available”, without any warranty, express or implied, as to its accuracy, completeness or suitability for a particular purpose.
- Specifications may change. ABEL continuously improves its Products. Designs, specifications, colours and features may change without notice. Images may show optional accessories that are not part of the standard supply.
- Performance varies. Actual output, lifting and digging capacity, and fuel use depend on the tractor model, horsepower, soil and site conditions, operator skill and maintenance. Figures on the Website are indicative, not guaranteed.
- Not professional advice. Website content does not replace advice from our sales or technical team. Confirm suitability for your application before buying.
- Prices and offers. Any price, scheme or offer mentioned on the Website or in our social media is indicative and applies only when confirmed in a written quotation.
- Third-party content. Links to third-party websites, logos of clients and testimonials are shared for reference only. ABEL does not endorse or take responsibility for third-party content or services.
- Fraud warning. ABEL does not ask for payments to personal bank accounts, or charge fees for dealership appointments through unofficial channels. To the fullest extent permitted by law, ABEL is not liable for any loss or damage arising from reliance on Website content or from the Website being unavailable.
9. Governing Law, Disputes and Contact
Governing law. These Terms are governed by the laws of India.
Disputes. Both parties will first try to settle any dispute through good-faith discussion within 30 days. If that fails, the dispute will be referred to arbitration by a sole arbitrator appointed by ABEL, under the Arbitration and Conciliation Act, 1996. The seat of arbitration will be Faridabad, Haryana, and proceedings will be in English. Subject to this, the courts at Faridabad, Haryana have exclusive jurisdiction.
Changes. We may update these Terms at any time. The “Last updated” date shows the latest version, and continued use of the Website means you accept the changes.
Severability. If any clause is found invalid, the remaining clauses stay in effect.
